5150 Mental Health Hold/Gun Confiscations
Under California Welfare and Institutions Code section 5150, law enforcement can detain and place an individual under a 72-hour involuntary confinement at a hospital if they believe the individual to be a danger to themselves or others. Even if the doctors determine the individual is not a danger to themselves or others, upon being admitted, the individual is automatically prohibited from owning or possessing firearms for 5 years.
Because of the extremely low standards that are required to uphold such a restriction, restoring your right to own and possess firearms can be extremely difficult. Most unfortunately, law enforcement uses section 5150 to pass the buck and routinely detain people who pose no risk to anyone.
With an in-depth knowledge and experience in dealing with these complex situations, Dillon Law Group can help restore your rights.
